These Terms govern your use of Baylou, a consumer health‑coaching app operated by OMEGAX HEALTH FZCO ("Baylou", "we", "us"). By creating an account or using Baylou, you agree to these Terms. If you do not agree, do not use the app.
1. What Baylou is
Baylou is a personal wellness coach that helps you set goals, plan your day, build habits, and track progress through chat, voice, planning, and self‑logging features. It offers general lifestyle, nutrition, movement, and habit guidance. It is not a medical service, telehealth provider, or pharmacy, and it does not provide medical advice, diagnosis, treatment, or medication guidance. You are responsible for decisions about your health and for consulting your own clinician.
2. Eligibility
You must be at least 18 years old and able to form a binding contract to use Baylou. By using the app you confirm that you meet these requirements.
3. Your account
You are responsible for your account credentials and for activity under your account. Keep your login secure and notify us promptly of any unauthorized use. You agree to provide accurate information and to keep it up to date.
4. Subscriptions, billing, and cancellation
- Baylou offers a free tier and paid subscription plans (for example Lifestyle and Longevity), available on weekly, monthly, and annual terms.
- In‑app purchases are processed and billed by Apple (App Store) or Google (Google Play) under their terms. Purchases made on the web are processed by our payment processor.
- Auto‑renewal: subscriptions renew automatically at the end of each period unless you cancel at least 24 hours before renewal. Manage or cancel your subscription in your App Store or Google Play account settings (or, for web purchases, via the billing portal in the app).
- Refunds are handled according to the policy of the store or processor you purchased through. Except where required by law or store policy, payments are non‑refundable.
- Prices and plan features may change; we will give notice of material changes, and changes apply to future billing periods.
5. Acceptable use
You agree not to misuse Baylou. In particular, you will not:
- use the app for any unlawful, harmful, or fraudulent purpose;
- rely on it as medical care, or use it to self‑manage a medical condition without your clinician;
- attempt to access, disrupt, reverse‑engineer, or scrape the service or its infrastructure;
- upload content you have no right to share, or that is unlawful or infringing;
- impersonate others or interfere with another user's use of the service.
6. Your content
You keep ownership of the content you create in Baylou (messages, plans, logs, photos, and voice). You grant us a limited license to host, process, and use that content to operate and improve the service and to provide your coaching, including processing by the AI systems and service providers described in our Privacy Policy. You are responsible for the content you submit and confirm you have the right to share it.
7. Health data and connected services
If you connect Apple Health, Android Health Connect, or WHOOP, you authorize Baylou to read the data categories you grant, solely to provide the features you request, as described in our Privacy Policy. You can disconnect or revoke access at any time.
8. Disclaimers
Baylou is provided "as is" and "as available", without warranties of any kind, whether express or implied, including fitness for a particular purpose, accuracy, or non‑infringement. We do not warrant that coaching, plans, or content will achieve any particular health, fitness, or weight outcome, or that the service will be uninterrupted or error‑free. Wellness guidance is general and may not be suitable for your individual circumstances.
9. Limitation of liability
To the maximum extent permitted by law, Baylou and OMEGAX HEALTH FZCO will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from your use of the service. To the extent liability cannot be excluded, our total liability is limited to the amount you paid us in the twelve months before the claim. Nothing in these Terms limits liability that cannot be limited under applicable law.
10. Indemnity
You agree to indemnify and hold harmless Baylou and OMEGAX HEALTH FZCO from claims arising out of your misuse of the service, your content, or your violation of these Terms or applicable law.
11. Suspension and termination
You may stop using Baylou and delete your account at any time. We may suspend or terminate access if you breach these Terms or to protect the service or other users. Sections that by their nature should survive termination (including ownership, disclaimers, and liability) will survive.
12. Changes to the service and these Terms
We may modify the service or these Terms. For material changes to the Terms, we will update the "last updated" date and provide notice in the app. Your continued use after changes take effect means you accept the updated Terms.
13. Governing law
These Terms are governed by the laws applicable to OMEGAX HEALTH FZCO's place of establishment, without regard to conflict‑of‑laws rules, except where mandatory consumer‑protection laws of your country of residence apply. Where required, you retain the protections of your local law.
